Terms of Service

These Terms govern your use of the BarrelFare iOS app (the "App"), operated by BarrelFare LLC ("BarrelFare", "we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. What BarrelFare is

BarrelFare surfaces surf-forecast and flight-price information to help you find good surf-and-travel "deals," and hands you off to third-party sellers when you want to book (see Section 3). It is an informational search tool only. We are not a travel agency, airline, tour operator, or booking service, and we do not sell flights.

2. Forecasts and prices are estimates

Surf scores, tide data, and flight prices are derived from third-party data sources and our own scoring models. They are estimates, may be inaccurate or out of date, and are not guarantees. Conditions change. Always verify surf, weather, ocean-safety, and current prices with authoritative sources before making any travel, financial, or in-water decision. You are solely responsible for your own safety in and around the ocean.

3. Flight bookings are with third parties

When you choose to book, the App hands you off to a third-party seller (Google Flights, the operating airline, or a travel agency) in a web view or your browser. Any purchase is made solely between you and that seller, subject to their terms, and the price is set by them: it may differ from the estimate the App showed and can change until you pay. We take no payment for flights, add no fees or markup, are not the merchant of record, issue no ticket, and hold no reservation in your name. Changes, cancellations, and refunds for flights are governed by the seller's and airline's own rules and handled by them (see our Support page). We may earn an affiliate commission on bookings, at no extra cost to you. We are not responsible for the third party's products, prices, availability, or conduct, nor for the airline's operation of the flight.

4. Your account

The App requires an account (Sign in with Apple, Google, or email + password) so your saved spots, home airport, and alerts can sync. You are responsible for activity that occurs through your device and account, and for keeping your credentials secure. You can delete your account at any time in the App (You tab → Account → Delete account). See our Privacy Policy for what data this involves.

5. Acceptable use

You agree not to: misuse or disrupt the App or its backend; attempt to access data that is not yours; scrape, resell, or commercially redistribute the App's data or content; or use the App in violation of any law. We may suspend or terminate access for misuse.

6. Subscriptions

The App's features are provided through a paid subscription, BarrelFare Pro, offered at $49.99 per year (with a 14-day free trial) or $5.49 per month (no free trial), or the equivalent shown in your local currency at purchase. Payment is processed by Apple through your App Store account: nothing is charged during the annual plan's trial, and the annual price is charged when the trial ends unless you cancel first. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period, and are managed and cancelled in your Apple ID settings. Pricing and what's included are shown at purchase. Refunds are handled by Apple under its policies.

7. Intellectual property

The App, its design, branding ("BarrelFare"), scoring logic, and content are owned by BarrelFare LLC or its licensors and are protected by law. Third-party forecast and price data remain the property of their respective providers. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that any forecast or price is accurate.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARRELFARE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON FORECASTS, PRICES, OR BOOKINGS MADE THROUGH THIRD PARTIES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Changes and termination

We may update the App or these Terms from time to time; material changes are reflected by the "Last updated" date. We may modify or discontinue the App at any time. You may stop using the App at any time and delete your data as described in the Privacy Policy.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.

12. Apple-required terms

These Terms are between you and BarrelFare LLC, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
